4.1 Workplace anti-bullying law takes effect

A new law aimed at preventing harassment[1] in the workplace took effect[2] in South Korea on Tuesday, bringing the widespread[3] but overlooked[4] issue of bullying at work into the legal domain. A revised law on labor standards, commonly called the workplace anti-bullying law, went into effect after a six-month grace period[5].

Under the new law, workplace harassment is defined as an act of incurring[6] physical or mental suffering or worsening of the work environment by employers or workers using their status or power to behave beyond the scope of working norms. If workplace harassment is reported, employers should immediately investigate it and take proper action[7], such as preventing victims from working with perpetrators[8] in the same place.

If retaliatory[9] or discriminatory[10] measures are taken against victims or against those who reported abusive conducts, employers could face a maximum three-year jail term and a fine of up to 30 million won, about $25,400. But the law does not stipulate[11] the punishment for a perpetrator.
